Personal Injury

 

This is a type of claim or a lawsuit in which the person or persons making the claim or bringing the suit, referred to as "plaintiff," has suffered harm to his or her body or mind. Personal injury claims are filed against the person or entity that caused the harm through one or more wrongful acts or neglect. Recoverable damages in personal injury claims may include the injured person's medical bills, past and future wage loss and/or earning capacity, pain and suffering, and diminished quality of life.

Vehicular Accidents

 

Accidents involving motor vehicles such as trucks, automobiles, motorcycles or bicycles make up a significant percentage of personal injury cases in the United States. Usually, an accident happens because someone isn't following the rules of the road or driving carelessly. In California, as in other states, an at-fault driver or motor vehicle operator may be held financially responsible for injuries and other damages stemming from an accident.

Wrongful Death

 

This kind of claim is brought by the family members of a deceased person whose demise resulted from the wrongful act or neglect of another person or entity. Much like personal injury claims, wrongful death claims may include negligence, gross negligence, reckless conduct, or intentional misconduct, and may arise out of motor vehicle accidents, dangerous conditions on private or public property, industrial accidents, occupational exposure to dangerous chemicals, defective products or medical malpractice. Recoverable damages in a wrongful death claim may include the surviving family member’s loss of the deceased’s financial support, medical bills and related expenses incurred before death, funeral and burial expenses, income the deceased would have earned had he/she remained alive, and loss of companionship.

Industrial Accidents

 

Every year, thousands of work related accidents result in serious injuries or death to workers in a variety of fields. While most people associate work injuries with construction or industrial fields, injury producing accidents happen in many other fields such as the service sector, material moving, transportation and production, arts, science, and management, etc. In addition to receiving worker’s compensation benefits, an injured employee, and, where appropriate, the heirs of a deceased employee, may be entitled to compensatory damages from those parties responsible for the injury producing event.

Premises Liability

 

Under California law, a person injured as a result of the negligent maintenance, upkeep and/or management of public or private property may be entitled to compensatory damages. Property owners have a duty to ensure hazards do not exist on their premises that could result in injury to others. These conditions may include trip hazards, stairs or steps with improper step geometry, slippery floors, uneven walking surfaces, etc.

Product Liability

 

Our culture has become dependent on more and more products to meet the needs of an ever-evolving, high-tech world. Consequently, individuals injured as a result of a defectively designed and/or manufactured product may pursue a claim for compensation for their injuries from the product manufacturer, as well as those entities and/or individuals in the chain of distribution such as a retailer, distributor, etc.

Dog Bites/Attacks

 

We love our canine companions; however, even Spot can sometimes go rogue and bite other people causing injuries or even death. In California, a dog owner is strictly liable for bite-related injuries caused by their dogs. Dog owners may also be liable for their dog’s non-bite injuries.
